Terms and Conditions

1. This Agreement expresses the full and complete agreement between the Client and Photography World By Rana Damien regarding the subject matter hereof. It supersedes all prior agreements. The only way to add or change this agreement is to do so in writing, signed by all parties.

2. The Client MUST pay the required session fee of $200 to retain Photography World By Rana Damien to perform the services specified herein. This payment confirms the session date. Packages and Products purchases are to be made and paid in full after images have been viewed and selected by Client. Once payment is received in full, images and/or products will be released to Client.

3. If the Client shall cancel this Agreement more than fourteen (14) calendar days before the portrait shoot, any booking fee paid to Photography World By Rana Damien will NOT be refunded but can be transferred to another date only if Photography World By Rana Damien is able to re-book the same date. If Photography World By Rana Damien is NOT able to secure another Client for the date, or if the cancellation occurs less than fourteen (14) calendar days before the portrait date, the Client forfeits the booking fee.

4. Photographs/images produced by Photography World By Rana Damien are protected by Copyright Law (all rights reserved). Upon final payment by Clients, Clients are allowed to display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of Photography World By Rana Damien. Clients will receive high resolution digital files with printing rights via digital download.

5. Images displayed on social media i.e. Facebook, Instagram, etc may be tagged and used as profile images providing they are not altered in any way and Photography World By Rana Damien must be noted and tagged as the photographer. No cropping is allowed and watermark must be visible on any images displayed on Client’s social media.

6. Photography World By Rana Damien reserves the right to use images created for advertising, display, publication, or other purposes. The Client signing this form warrants that he/she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend Photography World By Rana Damien in the event of litigation arising out of such use. Digital files and previews remain the exclusive property of Photography World By Rana Damien.

7. Upon signature and payment of session fee, Photography World By Rana Damien shall reserve the time and date agreed upon. It is the responsibility of the Client to provide accurate details as per the date and location of the portrait session and this is to be provided on the Portrait Booking Form. Any changes or updates to original information must be provided in writing.

8. Orders will not be processed or delivered until final payment has been received. Cash on pick-up is not available and prices are not negotiable.

9. If Photography World By Rana Damien cannot perform this Agreement due to unforeseen circumstances or other causes beyond the control of the parties, or due to photographer’s illness or emergency, then Photography World By Rana Damien shall either offer to reschedule session or return the deposit or session fee to the Client but shall have no further liability. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photography World By Rana Damien.

10. NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce the photographs elsewhere without Photography World By Rana Damien’s permission.

11. Proof images will be watermarked and are for viewing purposes only and may not be print screened, printed, or shared in any way.

12. Each image is hand edited by the Photographer Rana Damien to the best of her ability. Any further editing requests after the images are delivered will result in additional charges.

13. Fully edited images will be delivered via digital download to Client’s e-mail within 3 - 6 weeks of finalising payment AND confirming image selection

14. Due to the nature of the product, NO EXCHANGE of images will be allowed and NO REFUNDS.

15. A travel fee is applied to sessions which are carried out at the Client's home, or at an agreed outdoor location that is further than 30 km from Oran Park NSW 2570.

16. The Client is aware that colour dyes in photography may fade or discolour over time due to the inherent qualities of the dyes and the Client shall release Photography World By Rana Damien from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

17. The charges for any prints and/or frames are based on Photography World By Rana Damien’s standard price list. The price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
